1. Acceptance of Terms
These Terms of Service (“Terms”) constitute a legally binding agreement between you (whether individually or on behalf of an entity, “Client”, “You”) and Future Orbit Hub Co., Ltd. (“Company”, “We”, “Us”, “Our”), a registered corporation in Surat Thani, Thailand.
By accessing our website at future-orbithub.click, requesting an analytical scope estimate, or entering into a statement of work for telemetry auditing, cohort retention modeling, or engagement scoring advisory, you agree to be bound by these Terms. If you do not agree to these Terms, you must immediately discontinue use of the website and our advisory services.
2. Scope of Advisory Services
Future Orbit Hub Co., Ltd. provides professional consulting, telemetry pipeline auditing, behavioral data modeling, and mathematical engagement scoring advisory.
All diagnostic engagements are performed in accordance with mutually agreed written proposals or Statements of Work (SOW) executed between the parties. We provide technical findings dossiers, mathematical formulas, and SQL reference algorithms as advisory recommendations. Client maintains ultimate authority and responsibility over the implementation, deployment, and testing of any recommendations within their production application codebases.
3. Intellectual Property Rights
3.1 Company Materials
All text, graphics, origami theme elements, site code, whitepapers, framework diagrams, and foundational methodology published on future-orbithub.click are the exclusive intellectual property of Future Orbit Hub Co., Ltd. and are protected by applicable copyright, trademark, and unfair competition laws.
3.2 Client Work Deliverables
Upon full receipt of agreed commercial fees for a completed engagement, the Client receives full, perpetual, non-exclusive, irrevocable rights to all custom-tailored scoring formulas, SQL transformation queries, taxonomy blueprints, and written audit dossiers produced specifically for the Client’s application.
3.3 Client Data Ownership
The Client retains sole and exclusive ownership of all proprietary telemetry logs, tracking dictionaries, and user behavior data shared with Us during an engagement.
4. Confidentiality & Non-Disclosure
Both parties agree to treat all exchanged non-public business, architectural, and data schema information as confidential. Future Orbit Hub will not share, sell, distribute, or publicize any Client telemetry data, user identifiers, or proprietary metric benchmarks. When requested, a standalone mutual Non-Disclosure Agreement (NDA) will be executed prior to data transmission.
5. Limitation of Liability
To the maximum extent permitted by applicable law in Thailand:
- Future Orbit Hub Co., Ltd., its directors, employees, and contractors shall not be liable for any indirect, consequential, incidental, special, or punitive damages, including loss of profits, revenue, data, or business goodwill arising from your use of our website or implementation of our advisory deliverables.
- In no event shall our total aggregate liability arising out of or related to an engagement exceed the total fees actually paid by the Client to Future Orbit Hub Co., Ltd. under the specific Statement of Work giving rise to the claim during the six (6) months preceding the incident.
6. Governing Law & Jurisdiction
These Terms, and any disputes arising out of or related to our website or advisory services, shall be governed by and construed in accordance with the laws of the Kingdom of Thailand (TH), without regard to its conflict of law principles.
Any legal action, suit, or proceeding arising under these Terms shall be instituted exclusively in the competent courts located in Surat Thani or Bangkok, Thailand, and each party irrevocably submits to the exclusive personal jurisdiction of such courts.
7. Modifications to Terms
We reserve the right to revise and update these Terms periodically. Any changes will be posted on this page with an updated revision date. Continued use of the website after such changes constitutes acceptance of the modified Terms.
